What is the incentive for creditors to participate in the out-of-court mechanism?
Although the procedure starts even if creditors representing 50% of the claims against the company are interested, all creditors have an incentive to participate in the procedure, as otherwise there is a high probability that a binding decision will be taken to settle their claim without them participating.
